Matthew Ingalls
The complaint identifies Matthew Ingalls as a Cornell undergraduate and a member of Chi Phi's Xi Chapter at the time of the events. Jane Doe alleges that she went to the fraternity house that night to see Ingalls, whom she considered a friend.
According to the complaint, Ingalls gave Jane Doe a beer, later propositioned a threesome while she was heavily intoxicated, and brought her upstairs. The filing alleges that Ingalls and Johnathan Newell pressured her to take ketamine, supplied marijuana and high-proof liquor, and then engaged in sexual acts with her without consent. It specifically alleges that Ingalls forced oral sex on her.
The complaint further alleges that Ingalls later joined the other six named student defendants in pouring ketamine onto Jane Doe's body and snorting it. It says Ingalls and Winston Lee then took her into another room, instructed her to take more ketamine, and sexually assaulted her again while she was described as completely incapacitated.
Jonathan Newell
The complaint identifies Johnathan Newell as a Cornell undergraduate and member of Chi Phi's Xi Chapter at the time of the events.
According to the filing, Newell was in an upstairs room with Matthew Ingalls when the two pressured Jane Doe to take ketamine and supplied her with marijuana and high-proof liquor. The complaint alleges that Newell then forced vaginal intercourse on her, slapped her repeatedly hard enough to cause bruising, and continued reaching for her genitals after she pushed his hand away.
The complaint also alleges that Newell and Gillio Lopes later placed Jane Doe on a bed and sexually assaulted her without consent. At about 1:42 a.m., it says Newell posted a message in the “Chi Phi Actives” Snapchat group advertising sexual access to Jane Doe, after which additional fraternity members entered the room.
The filing further alleges that Newell forced her to take ketamine from his body, resumed groping her, and joined the other six defendants in pouring and snorting ketamine from her body.
Winston Lee
The complaint identifies Winston Lee as a Cornell undergraduate and member of Chi Phi's Xi Chapter at the time of the events.
According to the complaint, Lee was among the seven named student defendants who poured lines of ketamine onto Jane Doe's body and snorted them while she was lying on a bed. The filing then alleges that Lee and Matthew Ingalls moved her into a smaller room, made additional lines of ketamine, and instructed her to take more.
The complaint states that Jane Doe was completely incapacitated by that point. It alleges that Lee and Ingalls then sexually assaulted her simultaneously, forcing oral and vaginal sex, and that the assault continued until approximately 5:45 a.m.
Gillio Lopes
The complaint identifies Gillio Lopes as a Cornell undergraduate and member of Chi Phi's Xi Chapter at the time of the events.
According to the complaint, Lopes entered the room while Johnathan Newell was with Jane Doe, pulled her away from Newell, and began kissing her as Newell groped her from behind. The filing alleges that Lopes and Newell then placed Jane Doe on a bed and had sex with her without her consent.
The complaint further alleges that Lopes later joined Ingalls, Newell, Lee, Sarabia, Norris, and Kretzschmar in pouring lines of ketamine onto Jane Doe's body and snorting them while she lay on the bed. It says Lopes later left that room with Newell, Sarabia, Norris, and Kretzschmar.
Diego Sarabia
The complaint identifies Diego Sarabia as a Cornell undergraduate and member of Chi Phi's Xi Chapter at the time of the events.
According to the complaint, after additional fraternity members entered the room and Jane Doe hid her naked body under the covers, Sarabia approached her, grabbed her face, and began kissing her without consent. The filing says Jane Doe pushed him away.
The complaint further alleges that Sarabia later joined the other six named student defendants in pouring lines of ketamine onto Jane Doe's body and snorting them while she lay on the bed. It says Sarabia then left the room with Newell, Lopes, Norris, and Kretzschmar.
Scott Norris
The complaint identifies Scott Norris as a Cornell undergraduate and member of Chi Phi's Xi Chapter at the time of the events.
According to the complaint, Norris was among the seven named student defendants who poured lines of ketamine onto Jane Doe's body and snorted them while she was lying on the bed. The filing says Norris later left the room with Newell, Lopes, Sarabia, and Kretzschmar.
The complaint also reproduces a screenshot from the "Chi Phi Actives" Snapchat group. In that image, an account labeled "SCOTT NORRIS" appears to reply "Freee..." after Newell's message advertising sexual access to Jane Doe.
Scott Kretzschmar
The complaint identifies Scott Kretzschmar as a Cornell undergraduate and member of Chi Phi's Xi Chapter at the time of the events.
According to the complaint, Kretzschmar was among the seven named student defendants who poured lines of ketamine onto Jane Doe's body and snorted them while she was lying on the bed. The filing says he later left the room with Newell, Lopes, Sarabia, and Norris.
The complaint also reproduces a screenshot from the "Chi Phi Actives" Snapchat group showing an account labeled "SCOTT KRETZSCHMAR" participating in the discussion that followed Newell's message.
